Madama Luna (referred to herein as the “Seller”, “us”, “we”, or “our”) is the trade name and artistic pseudonym of Luna Scortegagna (the “Artist”), who operates the website madamaluna.com (the “Website”).

The Website may be accessed by individuals or legal entities (referred to as the “Buyer”, “you”, or “your”).

We collect different types of information for various purposes to provide and improve our Website to you within the meaning of Art. 4 No. 7 of the EU General Data Protection Regulation 2016/679 (“GDPR”).

By accessing and using the Website and/or placing an order, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy (“Policy”). Please read it carefully. If you do not agree to this Policy, you are expressly prohibited from using the Website and you must discontinue all use immediately.

By using the Website, you also represent and warrant that you are at least the age of majority in your state or province of residence.

1. TYPES OF DATA COLLECTED

1a. TECHNICAL DATA

When using our Website, we collect technical data that your browser transfers to us automatically. This data includes, but is not limited to, your IP address, time of access, requested Website data, referrer URL, operating system and browser version information (“Technical Data”).

1b. PERSONAL DATA

While using our Website, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Data”).

By placing an order request, submitting a commission request, filling out our contact form, or subscribing to our mailing list, we collect some Personal Data which you provide us with, such as, but not limited to, your name, email address, location, shipping and billing addresses. 1c. PAYMENT DATA

We offer the following payment methods: wire transfer and PayPal. For the execution of payments, we collect the payment data provided by you (“Payment Data”). We also receive further payment data from external payment service providers and credit agencies with whom we cooperate to process payments and conduct necessary credit checks. We only transmit data to our payment service providers as far as is necessary for payment processing and for the performance of the contract.

Depending on your user settings and your consent towards the respective payment service provider, that provider may store and collect your Payment Data. The respective payment service provider may use this data to automatically complete your Payment Data at checkout in order to facilitate a faster transaction.

PURPOSES

We process Technical Data solely for the purpose of providing you with the Website, to ensure the security and functionality of the Website, as well as for the evaluation of the use of the Website (Art. 6 (1) lit. f GDPR).

We process Personal Data in order to execute, perform and fulfill the contract concluded with you pursuant to Art. 6 (1) lit. b GDPR. Personal Data is especially necessary for us to be able to dispatch your order or commission. Additionally, the processing is necessary to protect our legitimate interest in investigating the loss of goods in transit (Art. 6 (1) lit. f GDPR). We process the name and email address you provide when registering to our newsletter for the purpose of sending you information about latest art launches, event invitations and special promotions on the basis of your previously given consent (Art. 6 (1) lit. a GDPR).

We process Payment Data in order to execute, perform and fulfill the contract concluded with you pursuant to Art. 6 (1) lit. b GDPR. This processing of your data is carried out on the basis of our legitimate interest in avoiding payment defaults, detecting and preventing fraud and crime (Article 6 (1) lit. f GDPR).

3. COOKIES

We may also collect information about your use of our Website through the use of technical cookies. These are small text files that are stored on your device that retain certain settings and data for the exchange with our system via your browser. A cookie usually contains the name of the domain from which the cookie data was sent, information about the age of the cookie and an alphanumeric identifier. When a user accesses the Website, a cookie is transferred to the hard drive of their computer or device. Cookies help us to improve our Website and to provide you with a better experience.

Technical, Personal and Payment Data will only be disclosed to our direct service providers, particularly our hosting providers or other technical service providers, strictly in connection with the provision and operation of the Website.

5. DATA DISPOSAL

The Technical Data is regularly deleted or aggregated immediately after leaving the Website.
Your Personal and Payment Data is generally deleted as soon as it is no longer required for the performance of the contract or the provision of your user account, unless there is no other legitimate purpose, such as the fulfillment of commercial or tax retention obligations. The Personal Data used for our newsletters will be stored as long as you have subscribed to the newsletter.

6. RIGHTS

You have the right to request information about the data we have stored about you in accordance with Art. 15 GDPR, to request the rectification of inaccurate data in accordance with Art. 16 GDPR and to request the erasure of data in accordance with Art. 17 GDPR or the restriction of data processing in accordance with Art. 18 GDPR.

Furthermore, you have a right to lodge a complaint with a competent supervisory authority pursuant to Article 77 GDPR if you consider that our processing of your Personal Data is not compliant with applicable law.

If you have given us consent to process your Personal Data, you can withdraw this consent at any time without providing reasons and with effect for the future at the email address provided below under the contact details. Additionally, at all times, we will offer you the opportunity to unsubscribe from any service or update to which you have subscribed, if you change your mind. Newsletters will contain an easy automated unsubscribe link so that you can opt-out of that particular service and easily exercise your right to withdraw your consent to the sending of the newsletter and any other services or updates to which you have subscribed.

7. TERMS AND CONDITIONS

This Policy, together with our Terms and Conditions, constitute the entire agreement between you and us regarding your use of the Website and the purchase of any Artwork, and supersedes all prior or contemporaneous communications and proposals, whether oral or written.

We reserve the right to modify or revise this Policy at any time, at our sole discretion, and without prior notice. Your continued use of the Website following any changes constitutes your acceptance of those changes. You are advised to review this Policy periodically to remain informed of any changes.
